
Adjudication is a process which is intended to introduce a speedy and inexpensive mechanism for settling disputes under construction contracts. It is now the Construction Industry’s preferred method of resolving its disputes. Since its implementation through the Housing Grants, Construction and Regeneration Act 1996 (HGCRA), all construction contracts are now deemed to include a right for the contracting parties to refer a dispute arising under a contract for adjudication at any time. Most standard forms have now also been updated to include the adjudication provisions of the HGCRA.
The key points about using adjudication for settling disputes:
- It is available to either contracting party at any time
- It is quick – the entire process normally only takes 28 days
- It is inexpensive – partly due to the speed of the process but also because formal legal representation is not (normally) required
